Aamsko project consultants have extensive experience serving as the Engineer to the Contract under NZS 3910 and 3916, and more recently as Contract Administrators. The Engineer must be an individual with suitable qualifications, rather than a company or firm. This person is appointed by the Principal and fulfils a dual role:
— As an expert adviser and representative of the Principal, the Engineer directs the Contractor on behalf of the Principal and acts as the Principal’s agent in receiving payment claims and providing Payment Schedules.
— Independently of either contracting party, the Engineer fairly and impartially makes decisions entrusted to them under the Contract, values the work, and issues certificates.
As the Principal’s agent, we will act in the Principal’s best interest, using our expertise to provide expert advice and representation. For instance, when receiving payment claims and issuing progress schedules, we do so explicitly in our capacity as the Principal’s agent.
When deciding on approving and valuing variations, verifying unforeseen physical conditions, granting time extensions, or evaluating the contractor’s payment claims, we will serve as unbiased contract administrators.
Any disagreements between the contractor and the principal will be directed to the Engineer or Contract Administrator for an Engineer’s determination. In this quasi-judicial capacity, we will conscientiously fulfil our responsibilities with integrity.
